摘要:随着社会经济的发展,我国不动产事业已经有了极大的发展,但是有关不动产的立法却相对滞后,我国现行法律虽然对不动产登记做了规定,但过于零散,缺乏规范性与统一性,不动产物权登记制度存在诸多不完善的地方,这不仅不利于我国不动产物权的管理,也阻碍了我国社会主义市场经济的发展完善,建立完善的不动产登记制度对于稳定不动产的市场交易秩序,保护权利人的合法利益,促进我国经济的发展具有重大意义。本文首先对不动产登记制度的重要效力进行概述,然后分析了世界范围内不动产登记制度类型,接着分析我国不动产登记制度中存在的问题与缺陷,最后在借鉴西方发达国家不动产制度理论的基础上,提出了自己的一些浅薄建议,希望对完善我国现行不动产登记制度有所帮助。

Abstract:With the development of society and economy, the real estate business in our country has undergone great advancement. However, the legislation of real estate has fallen behind. Although there are some regulations on the registration of real estate in our present law, these regulations are loose and not unified. Apparently, there are a lot of loops in real estate registration process, which is not good for the management of real estate rights and hinders the development of our social market economy. Therefore, it is of great importance to establish sound real estate registration system in order to stabilize marketing economy and protect legal rights of the relevant party, together with promoting the development of our economy. This paper first introduces basic theories of real estate registration and its important effect, then analyzes the problems and flaws in China’s present real estate registration. Finally, this paper offers some points on the basis of learning basic theories on real estate registration in developed countries with the hope of proposing perfecting China’s real estate registration system.
