摘要:劳动争议调解制度是我国劳动争议处理制度的重要方式之一。然而,在实践中,由于存在调解机构缺乏独立性、调解人员素质不高、调解协议无强制力的问题,该制度未能发挥其应有的积极作用。有关数据统计表明,在劳动争议案件持续上涨的今天,劳动争议调解委员会调解的案件数量反而下降。相比之下,国外的劳动争议调解制度相对较健全完善,如美国、德国等都设有专门的独立的调解机构,并且取得了很好的调解效果。为此,我国应借鉴国外先进的经验来完善劳动争议调解制度,使其充分发挥“第一道防线”的作用。

Abstract:Labor dispute mediation system is an important part of China’s Labor Dispute Resolution System . However, in practice, due to lack of independence existence mediation organization staff quality, mediation is not high, the conciliation agreement without the problem, this system enforecement to exert its positive role. Relevant data statistics show that in a labor dispute case, the rising of labor dispute mediation committee today will decrease the number of cases that mediation. Compared with the foreign labor dispute mediation system, relatively perfect as the United States, Germany, etc have special independent mediation organization, and achieved good mediation effect. Therefore, our country should learn from foreign advanced experience of labor dispute mediation system perfect, make its adequately “the first line of defense”.
