摘要:商标仿冒,是指擅自将他人的注册商标作近似的使用,造成与他人注册商标相混淆,足以引起购买者误认的行为。当今世界,商标仿冒现象愈发猖獗。在国内市场上,知名企业频频被侵权,优秀企业创品牌难;在国际市场上,我国商品屡屡被查封扣押,有损国家形象。我国要形成良好的市场竞争秩序,促进贸易发展,提高综合国力,必须重视并有效遏制商标仿冒行为。
本文主要通过研究我国《商标法》,并参考英、美、日三国的商标法律规定,提出进一步完善我国商标仿冒的法律规制的建议。主要包括:提高民事赔偿数额、提高行政处罚力度、增加企业商誉的保障赔偿。

Abstract:Trademark counterfeiting, unauthorized use of registered trademarks of others approximate, causing confused with others registered trademark enough to purchase misidentification behavior. In today's world, the phenomenon of trademark counterfeiting increasingly rampant. In the domestic market, the well-known enterprises frequently been infringed, excellent enterprise brand is difficult;in the international market, Chinese goods has been used sequestration detrimental to the image of the country. China should establish a good market competition in order to promote the development of trade, and improve the comprehensive national strength, must pay attention to effectively curb the trademark counterfeiting.
This thesis by studying Trademark Law of China and reference to the trademark law in British and the United States, Japan, proposed suggestions to further improve the legal regulation of trademark counterfeiting. Mainly include: increasing the amount of civil damages, improve administrative penalties and increase the protection of corporate goodwill compensation.
