摘要:惩罚性赔偿制度是为了惩罚和遏制被告的违法行为，而判给原告超过其所受损害的金钱赔偿责任制度。我国建立食品安全领域中的惩罚性赔偿制度的时间不长，适用并不广泛，存在的缺陷也比较多。本文从完善食品安全领域中的惩罚性赔偿制度的重要性出发，研究我国食品安全领域中的惩罚性赔偿制度存在的主要问题，并从我国实际情形出发，借鉴国外的惩罚性赔偿制度的经验，提出完善我国食品安全领域中的惩罚性赔偿制度的建议。

Abstract:The punitive damages system is to punish and deter the defendant's violations and judge plaintiffs more than they have suffered damage compensation.It’s not so long and used widely to bulid the punitive damages system in The Law of Food Safety in our country. Based on the punitive damages system’s importantce, the paper pointed out that the necessity and importance of the punitive damages system set up in our country and analyses the major problem of the punitive damagess system.In terms of the practical situation,our country uses the good experience of puntive damages system in foreign country for reference. And then writer gives some suggestions to improve the punitive damages system in The Law of Food Safety in our country.
